Assisted Reproductive Technology in Estate Planning: Drafting Considerations

With advancements in reproductive technologies, estate planners face unique drafting challenges for clients who have children (and more remote descendants) born through the use of assisted reproductive technology (ART). We will begin the presentation defining ART and reviewing the inheritance rights of posthumously born heirs under Ohio law. We will also review recent court decisions that affect ART such as the classification of gametes/embryos as property versus persons, dealing with fertility clinic contracts, and drafting pitfalls. Obstacles for fiduciaries and best practices will close out the presentation.
