Immigration practitioners are experiencing unprecedented denials of employment-based petitions and other applications for immigration benefits by USCIS. This 2-hour seminar will serve as a primer on filing a federal lawsuit against USCIS for unwarranted or inappropriate denials. The focus of the training is on Administrative Procedure Act (APA) claims, with a brief overview of mandamus actions. This training will provide a foundation for practitioners with little or no litigation experience to (1) prepare cases with an eye toward litigation; (2) develop talking points and strategies to encourage clients to litigate cases that are unlawfully denied; and (3) start building district court litigation as a regular component of their law practice.
