Ethical Considerations in Cross-Border Practice

Today’s attorneys engage in cross-border practice on a routine basis, whether
advising clients about another state’s laws or reviewing transactional agreements for a
U.S. client with a foreign counterparty. This interactive CLE will explore when attorneys can competently address cross-border issues as Ohio lawyers and when they should associate with foreign counsel for advice. Topics include:
• Advising on litigation under another state’s laws.
• Appearances of foreign counsel in Ohio state and federal courts.
• Appearance of Ohio counsel in arbitrations outside Ohio.
• Advising on transactions and commercial relationships with foreign companies.
• Traveling to foreign countries to represent the client in M&A negotiations or depositions.

Patterson III will interpret and explain the application of Ohio’s trust account rule, in compliance with the decisions of the Ohio Supreme Court and the advisory opinions published by the Board of Profes- sional Conduct. Additionally, they will explain the impact of federal banking law on a lawyer’s duty to safeguard funds held in a trust account.
