Background
Marjorie Corman Aaron now an Emerita Professor of Practice and Director, Center for Practice, at the University of Cincinnati College of Law, teaching courses in mediation, ADR, client counseling, decision analysis, and trial practice. She received the College of Law’s Schott Scholarship Award in 2019 and Goldman Prize in 2010, and a University President’s Excellence Award in 2006. She has been guest faculty at the University of Graz, University of Michigan Law School, and a summer institute at Harvard Law School and U.N.L.V’s School of Law. Professor Aaron has also taught workshops on ADR, mediation, negotiation, client communication, and decision analysis for law firms, court panels, corporations, and other organizations.


Professor Aaron has practiced as a neutral mediator and an arbitrator of legal disputes for more than 30 years. She has handled cases involving commercial contracts, employment disputes - age, gender, sexual harassment, race, religious discrimination and wage and hour issues, business fraud and torts, securities, products liability, personal injury, small business, partnership, and family business disputes, construction and design claims, multi-party construction disputes, insurance, franchisee-franchisor disputes, commission sales, non-compete, environmental claims, real estate and business valuation, medical and other professional malpractice. Under special master appointment, served as mediator and arbitrator for allocating class action settlements.


Prior to her move to Cincinnati, Professor Aaron was Executive Director of the Program on Negotiation at Harvard Law School ("PON"). She was a Senior Mediator and Vice President at Endispute (now JAMS-ADR) and mediator for the Middlesex Multi-Door Courthouse. A graduate of Princeton University and Harvard Law School, Professor Aaron began her career as a litigator at Goodwin Proctor in Boston, and then as prosecutor in Plymouth County, MA.


Professor Aaron is the author of Risk and Rigor: A Lawyer’s Guide to Assessing Cases and Advising Clients (DRI Press, 2019) and Client Science: Advice for Lawyers on Counseling Clients through Bad News and Other Legal Realities (Oxford University Press, 2012), and Negotiating Outcomes: Pocket Mentor Series (Harvard Business School Press, 2007). She has authored many chapters, articles and case simulations in mediation, negotiation, and decision analysis and produced videos on effective practice.

Mark has had a focus on the construction industry for many years in his practice. Mark has represented owners (public and private), contractors, specialty contractors, and professionals in a wide variety of disputes in several different states. The projects have included commercial buildings, bridges, roadways, manufacturing plants, industrial power plants, electrical stations and projects on nuclear sites. Mark has pursued and defended all types of claims including delay, acceleration, change orders and resulting impacts, MCAA factors, and basic claims for breach of contract. The claims have ranged in amounts from $200,000 to $25 million +.

During Mark's 40 year career at Dinsmore, he has also had the opportunity to provide counsel in a wide variety of practice areas. Mark has served as lead counsel on sale and merger transactions with values of several hundred thousand dollars up to transactions of over $100 million. By representing tower companies, Mark has gained valuable experience in the commercial real estate and regulatory areas. During his career, Mark has served as outside "general counsel" for numerous clients which has provided him with extensive experience in day to day employment issues and disputes, including noncompete and non-solicitation litigation, and commercial financing (including workout) transactions.

Mark has tried to judgment cases in arbitration as well in State and Federal Courts, including jury and bench trials. Most trials have included construction projects but the most recent bench trial involved the defense of a multimillion dollar claim based on an "earn-out" provision contained in an Asset Purchase Agreement. Mark and his partner obtained a full defense verdict.

While always an aggressive advocate for clients, Mark has also worked to exhaust settlement efforts to avoid costly litigation and trials by working with opposing counsel or through mediation to bring disputes to a negotiated resolution. Mark has served as counsel to parties in single and multi-party mediations that have occurred in numerous jurisdictions including Ohio, New Jersey, Missouri, Wisconsin, Washington D.C., Kentucky, and Alabama.

In furtherance of Mark's interest in cost effective and timely resolution of disputes, Mark completed a 40 hour mediation training course at the Libscomb University Institute for Conflict Management in Nashville. Background
Prior to joining Vorys, Libby served as a judge on the Hamilton County Court of Common Pleas. During her time on the court, she presided over business matters and matters in equity. Tom Eagen is a graduate of the University of Notre Dame and of the University of Cincinnati College of Law. The primary focus of Tom’s law practice has been civil litigation. Over his forty-five year career, Pinney has served as counsel or as mediator or arbitrator in scores of cases. As a mediator, Pinney started as a volunteer mediator with U.S. District Court and, in 2004, was formally trained as a mediator in a comprehensive program presented by the International Institute for Conflict Prevention and Resolution at The Hague. He was named a Fellow of the London-based Chartered Institute of Arbitrators in 2017 upon passing its rigorous course and is currently the North American Branch's Vice-Chair for Training.
